Mother Sentenced for Toddler’s Death
A New Mexico mother was distraught in court as she received a sentence related to the death of her 2-year-old son, who accidentally shot himself with a gun she had kept in her bag.
Amilia Garcia, age 21, was sentenced to 10 years in prison on Wednesday for the tragic incident that occurred last April while she was at an apartment with three friends. Reports indicate that the gun was accessible to her son, Leon, leading to the fatal accident.
Prosecutors had requested a 23-year prison term, labeling Garcia’s actions as “reckless.” The mother defended her decision to carry the firearm for self-defense but acknowledged that it was not properly secured.
During the hearing, New Mexico Deputy District Attorney Savannah Brandenburg Koch pointed out the serious risks of having firearms around children. “She knew there was a significant risk,” she stated.
Garcia, visibly emotional, pleaded for a lighter sentence, expressing her sorrow over losing her child. “No punishment can match the pain I endured from losing my son,” she said through tears, adding, “My sons are everything to me.”
Reports detail that while Garcia was asleep, Leon managed to obtain the gun and tragically fired it. After the incident, two of Garcia’s friends fled with the remaining firearms.
Garcia had earlier pleaded guilty to charges including child abandonment and tampering with evidence. Judge David Murphy considered the circumstances and opted for a lesser sentence, stating that the charges did not meet the threshold of serious violence.
“This case presents unique challenges,” the judge remarked, referencing Garcia’s claims of past abuse. He emphasized the gravity of the loss, saying, “Leon Jr. lost his life.”
After the prison term, Garcia will have a five-year suspended sentence. Judge Murphy offered his condolences to her during the proceedings, stating, “I hope you’re okay.”
In related news, last month, a friend of Garcia named Angel Morales was sentenced to two years in prison for evidence tampering, while another individual involved is still awaiting sentencing.
