Trump Nominates Adam Khandoub to Lead DOJ Antitrust Division
The White House has announced that President Donald Trump has nominated Adam Khandoub, currently serving as general counsel at the FCC, for a significant role in the Justice Department’s Antitrust Division. According to White House official Saurabh Sharma, Khandoub will take on the position of assistant attorney general, primarily focusing on antitrust enforcement.
This nomination must go through Senate confirmation, a process that could stretch on for months. Presently, the Justice Department lacks a Senate-confirmed director for its antitrust division, with Deputy Attorney General Stanley Woodward overseeing the division as the third-ranking official.
Until last month, the antitrust division was temporarily led by Acting Director Omeed Assefi, following the dismissal of Abigail Slater in February. This shift is part of a broader restructuring within the department’s leadership.
Khandoub comes to this role with a robust background in telecommunications policy and regulatory affairs. In 2020, he held the position of Acting Administrator for the National Telecommunications and Information Administration (NTIA), where he worked on reinterpreting legal protections for tech companies under the Communications Decency Act.
While at the Telecommunications Authority, Khandoub and his colleagues contended that Section 230 of the 1996 CDA, which generally protects tech companies from liability for user-generated content, should not extend to their choices regarding content moderation. This perspective places him at the forefront of ongoing discussions around technology regulation and content oversight.
This appointment follows a period of reduced antitrust enforcement under the previous Trump administration, as noted in earlier reports. During his attorney general confirmation process, Todd Blanche addressed concerns about the department’s perceived lack of assertiveness against anticompetitive practices in court.
In his written responses to senators, Blanche stated, “The Department of Justice’s Antitrust Division has aimed to provide immediate results for the American public, rather than putting them through lengthy legal battles with unpredictable outcomes.”
The Antitrust Division is crucial for upholding federal competition laws and examining significant corporate mergers and acquisitions. Khandoub’s leadership is likely to influence how the government navigates competition policy, especially regarding technology firms and other vital sectors.
