JERUSALEM – The International Criminal Court (ICC) prosecutors, already facing scandals, revealed on Friday that Karim Khan will be stepping aside while an investigation into allegations of sexual misconduct occurs. Khan has firmly denied these accusations.
A inquiry was made by Fox News Digital on Thursday, asking Khan whether he would resign or if the ICC had plans to remove him from his position. In a statement, the court noted that Khan had opted to take leave during the ongoing investigation, which is being overseen by the UN’s internal monitoring agency.
Women’s rights organizations have applauded this decision but have also urged Khan to resign after the allegations surfaced last year. Initially, however, he resisted calls to step down.
Previously, an Associated Press investigation reported that two court employees were approached by a woman who shared her experiences of alleged misconduct by Khan back in May. This coincided with Khan’s request for a warrant against Israeli Prime Minister Benjamin Netanyahu and several Hamas leaders on charges of war crimes.
Israel is engaged in an ongoing conflict with Hamas, which it labels as a terrorist organization, sparking unprecedented violence since October 7, 2023, when attacks resulted in over 1,200 fatalities, including American citizens.
Legal expert Eugene Kontorovich remarked on the situation, stating that this scandal—entailing significant prosecutor misconduct—could bring into question not only the future of the prosecution but also the very existence of the ICC, considering the court’s long history without substantial convictions for serious crimes.
The court’s internal watchdog, upon investigating the allegations, reportedly closed the inquiry just days after interviewing the woman, without granting her the option to file a formal complaint. Although they found no definitive fraud, they recommended that Khan limit his interactions with women and ensure the integrity of the court.
Khan faces mounting pressure from various quarters. In February, sanctions were imposed against him by then-President Donald Trump concerning the Israeli warrant. Such sanctions might hinder broader investigations within the court.
The situation is further complicated by reports that Khan’s investigations and decisions might be influenced by his current legal battles and an apparent desire to protect his own position.
Despite the turmoil, Khan’s legal representation insists that he is fully cooperating with the United Nations’ inquiry regarding the allegations. They emphasized that his decision to call for an arrest warrant against Netanyahu and others was based solely on legal grounds, not as a means to deflect attention from the misconduct claims.
Overall, the ICC’s credibility continues to hang in the balance as the complexities of these intertwining situations unfold.
