Judge Prevents Trump from Stripping Birthright Citizenship for Children of Undocumented Immigrants

Judge Blocks Trump’s Order on Birthright Citizenship

A federal judge, appointed by former President George W. Bush, has halted President Donald Trump’s executive directive aimed at ending birthright citizenship for children born in the U.S. to illegal immigrants.

On Thursday, U.S. District Court Judge Joseph Laplante issued a class-wide interim injunction in favor of the foreign nationals who filed a lawsuit against the Trump administration.

This legal action is connected to the Open Society foundations established by George and Alex Soros, as reported by Breitbart News in April.

“After reviewing the various filings, declarations, and applicable laws, the court has decided to grant the petitioner’s claim for a class-wide interim injunction,” Laplante stated.

The court determined that the petitioners have demonstrated a likelihood of success in their claims. A member of this group could face irreparable harm if the injunction isn’t issued; the potential harm to the petitioners far outweighs any possible harm to the respondents if the injunction is granted. Additionally, issuing this order serves the public interest.

In line with Federal Civil Procedure 65(a), the court has ordered several government departments to refrain from enforcing the executive order regarding American citizenship. This includes the Department of Homeland Security and the Secretary of State, among others. The injunction will remain in effect for seven days while any appeals are considered.

The court also evaluated submissions from both sides and decided to provisionally recognize the class represented by the petitioners, noting that their concerns reflect those of the group as a whole.

The court found that the petitioners satisfy requirements for provisional class certification under the Federal Rules. There are shared legal and factual issues, and the petitioners’ interests align with those of the class they represent. Therefore, the court will tentatively allow for appropriate injunctive relief to all members of the class, though no final resolutions are available at this time. The certification pertains to all individuals born after February 20, 2025, along with those yet to be born.

Last month, the U.S. Supreme Court clarified that lower district courts cannot issue nationwide injunctions without a class action lawsuit that demonstrates a general injury.

Consequently, the plaintiffs in the birthright citizenship case sought a recognition of their group status to contest the executive order.

Shortly after assuming office, Trump issued an executive order aimed at ending birthright citizenship for children of illegal immigrants. Each year, about 250,000 “anchor babies” are born in the U.S., which helps their undocumented parents remain in the country.
