Education Department Set to Reduce Funding for 5 Virginia School Districts Due to Transgender Policies

The Department of Education has announced its intention to withdraw federal funding from five school districts in Northern Virginia. This decision comes after these districts opted to maintain a policy that permits students to utilize bathrooms and locker rooms according to their “gender identity,” as opposed to biological sex.

The affected districts include Alexandria City Public Schools, Arlington Public Schools, Fairfax County Public Schools, Loudoun County Public Schools, and Prince William County Public Schools. They recently dismissed a request from the Trump administration to alter their transgender policies. Reports indicate that the Education Department claims these districts are violating Title IX, which prohibits sex discrimination in federally funded educational programs and activities.

Education Department spokesperson Maddie Biederman stated that the process to suspend or terminate federal funds for these districts will commence soon.

Biederman remarked, “The U.S. Department of Education has provided extensions to these five Northern Virginia school districts to align with Title IX. Unfortunately, this additional time has not yielded any positive results.” She indicated that administrative actions to enforce the funding withdrawal will begin, arguing that the districts must justify their commitment to what she called a “radical gender ideology” to ensure student safety.

Loudoun County was the first of the five districts to reject the request from the Trump administration, voting 6-3 at a meeting on policy 8040.

A spokesperson for the district mentioned that the federal understanding of Title IX conflicts with state law.

They said, “After consultations with legal counsel, the board decided 6-3 to ignore this request because of the tensions between the current law and OCR guidance. We will keep monitoring developments to protect all students’ legal rights.”

Reports suggest that the other four districts have requested that the Department hold off on its claims until there is a clear court determination regarding the applicability of Title IX to gender identity.

In a response, the lawyers for Alexandria Public Schools argued in a letter to the OCR that the Trump administration’s demand was an endeavor to limit the rights of transgender students.

The OCR initiated an investigation into the district following a complaint alleging violations of gender-based protections under Title IX for transgender-identifying students.

The Department is facing multiple lawsuits and informal complaints, with reports indicating that some students avoid using school bathrooms when possible due to the existing policies. Additionally, there are claims of inappropriate interactions in locker rooms.

The proposed agreement from the Department included several key points:

  • Reversing policies that allow students to access facilities based on “gender identity” instead of biological sex.
  • Issuing a memorandum to ensure that future policies regarding intimate facilities adhere to Title IX by strictly segregating students based on biological sex, thus guaranteeing equal opportunities for women in educational programs.
  • Implementing definitions of “male” and “female” grounded in biology across all practices linked to Title IX.

Biederman also stated, “While the previous administration may have tolerated such practices, it is essential to challenge Northern Virginia’s extreme gender ideology and discrimination. The OCR investigation clearly indicates that these five school districts are infringing upon student rights in favor of a radical political agenda.”

She concluded, “The Trump administration will not jeopardize the safety and dignity of young women in America for the sake of unsupported beliefs.”
