Boston Federal Judge Blocks Trump’s H-1B Visa Fees

A federal judge in Boston has put a stop to the Trump administration’s proposed $100,000 fee for H-1B visas, labeling it a fraudulent tax that lacked Congressional approval. This policy, implemented last year, dramatically raised fees from a previous $2,000 to $5,000, supposedly to prioritize U.S. citizens in the visa process. In response to this ruling, the White House has announced plans to appeal.

In another related development, Microsoft is facing backlash after approving thousands of foreign worker visas while announcing plans to lay off 4,800 staff, with 1,600 cuts coming from the Xbox division, a significant sector of the company known for its gaming consoles.

The tech giant has been allowed to hire 2,273 foreign workers this year through the H-1B visa program, a fact that has stirred anger among critics who argue that American jobs are being handed to foreign workers as part of cost-cutting measures. It’s frustrating, really. Many believe this harms American employees.

Some users on social media expressed strong feelings about this situation. One suggested harsh consequences for companies that replace Americans with visa holders, implying serious repercussions for such actions. Another lamented how government policies seem to force jobs overseas, which definitely adds to the current frustrations.

The ongoing H-1B program has not been without controversy, as critics label it an “industrial-scale job theft,” especially targeting large companies like Microsoft, which has an increasing number of applicants from India. Despite its global reach, the majority of its workforce is based in the U.S.

Amid the tumult, a lawmaker has called for the complete termination of the nonimmigrant visa program. Lawmakers are visibly upset over it, stating that companies are exploiting immigration programs to sideline American workers.

In the midst of the layoffs, Xbox CEO Asha Sharma cited the need for a “reset” of the Xbox business, pointing to poorer profit margins compared to its counterparts. However, some critics question whether her leadership—given her Indian heritage—impacts the dynamics around the hiring of foreign workers.

In a related announcement, Vice President J.D. Vance revealed that the federal Department of Labor has started numerous investigations into potential fraud within the H-1B visa program, emphasizing a commitment to protecting American jobs.

Recently, President Trump also attempted to tighten employer access to the H-1B program with the new fee, but the federal judge’s ruling stands in opposition to that move, illustrating the ongoing contention over immigration policy.

Fox News Digital has reached out to Microsoft and Xbox for comments on the situation.
