Investigation into ICE-Involved Shooting in Harris County

Harris County District Attorney Sean Teare has announced that his office will investigate the shooting incident involving the U.S. Immigration and Customs Enforcement (ICE) agency and Lorenzo Salgado-Araujo. This investigation will run alongside the FBI’s inquiry. Teare is particularly interested in gathering any videos, photos, or witness accounts from the public, noting that this could potentially hinder ongoing federal investigations.

The incident occurred during a police raid in Houston on Tuesday when the 52-year-old Salgado-Araujo allegedly attempted to run over a police officer while fleeing. ICE officials later confirmed that Salgado-Araujo was an undocumented Mexican national.

In a related discussion, Bob Price, Deputy Editor at Breitbart Texas, emphasized the need for a transparent investigation into Salgado-Araujo’s shooting during a panel on Fox 26 Houston.

Law enforcement stated they were attempting to stop Salgado-Araujo’s vehicle as part of a coordinated operation aimed at apprehending individuals living in the U.S. illegally. Following a tip-off about two vans near Salgado-Araujo’s residence, they engaged with his vehicle. An ICE statement indicated that he reportedly rammed their vehicle and ignored commands before using his car in an aggressive manner, leading officers to fire in self-defense.

Emergency services responded post-shooting, but Salgado-Araujo ultimately died from his injuries at a local hospital. The FBI’s Houston office is taking the lead on investigating the shooting and any potential assault on federal officers.

Teare shared on Houston Public Media’s Hello Houston Show that while he is investigating the matter, he has not been directly asked to join the federal inquiry. He expressed concern over the limited access his office has compared to other officer-involved shooting investigations.

“If a national crime is committed—whether it’s murder or tampering with evidence—we’re going to look into it,” Teare asserted, aiming to uncover the truth behind the actions of ICE officers involved in the incident.

Teare reportedly received significant campaign support from the Texas Justice and Public Safety Political Action Committee, associated with George Soros, which has sparked discussions about his progressive stance on criminal prosecution.

Harris County officials, including Mayor John Whitmire, support a thorough investigation, with Whitmire reaffirming the city’s commitment after meeting with Salgado-Araujo’s family. Current Sheriff Ed Gonzalez also expressed condolences, emphasizing the need for transparent justice for the affected family.

As investigations progress, it’s notable that none of the Harris County Democratic Party officials, including Teare, have shown support for the federal officers involved in the shooting.

Teare may face legal challenges if he pursues prosecution against the federal agents. Under the Supremacy Clause of the U.S. Constitution, federal employees are generally protected while acting within their official capacity, making it complex to hold them accountable in state courts.

Law professor Robert Weisberg discussed how federal standards favor police officers when they use deadly force, focusing on the circumstances they faced at that moment. If a federal judge finds that the actions of the ICE officers were within policy guidelines, this may result in the dismissal of any future state charges against them.

A recent Fox 26 panel further explored the details surrounding the shooting and its implications. The discussion follows incidents that have raised questions about law enforcement approaches in situations involving undocumented individuals.
