Thug brutally beats older, smaller deli worker — and keeps kicking victim’s bloody face even after he’s motionless on floor

Earlier this month, a man was caught on security camera brutally beating a much older and much smaller deli worker in New York City, and the footage shows the attacker continuing to kick his victim in the bloody face even after he lay motionless on the floor, unconscious.

Police told the New York Post that the suspect, who is covered in tattoos of skulls, hearts and the word “KILLER” in all capital letters, had been arrested 25 times, mostly for robbery, adding that he had been arrested twice before.

Perhaps most damningly, the victim appeared to be motionless and unconscious after the perpetrator’s third kick, meaning that the final 10 kicks to the victim’s increasingly bloody face were likely delivered after the victim was already unconscious and completely defenseless.

Victim’s son He told WABC-TV Last week, his son said his father was in critical condition at Elmhurst Hospital with bleeding on the brain and facial fractures, adding to the station that “some bones have been detached from a very important part of his face.”

According to WABC, the brutal assault took place around 11:20 p.m. on June 17 at a store at the intersection of 64th Street and Broadway in the Woodside neighborhood, and escalated when the victim confronted the assailant who had bumped into him.

Neighbors told the station they recognized the suspect seen in the video, who has green hair.

“When the green hair was mentioned I knew it was him because everyone was looking at him. Everyone crosses the street when they see him. He’s a weirdo. Definitely a weirdo,” one resident told WABC.

Another resident told police the suspect frequently talked to himself and was out at night.

The victim’s son told WABC his father was a “really good guy.”

“He’s kind of old-fashioned, talking to strangers,” he told the TV station about his father, “It sounds cliché, but he’s the kind of person who would help a stranger.”

Suspect arrested

Police arrested the suspect on Wednesday after a standoff between police and authorities. He told amNY.

Citing police, the outlet reported that 29-year-old Osbel Diaz, of Forest Hills, had attempted to shave off his green hair to evade police.

amNY reports that the victim of the attack was 62 years old and that the incident happened at the Sunnyside Minimarket. The victim’s condition was initially critical, but he is now said to be slightly improving.

Detectives and the NYPD’s patrol unit pursued Diaz at his home on 62nd Street, amNY reported, adding that the suspect resisted.

A source familiar with the investigation said Diaz briefly barricaded himself inside the home with the 3-week-old baby, but after a brief standoff, police were able to detain him and rescue the baby, who was unharmed.

Detectives took a handcuffed Diaz from the 108th Precinct in Long Island City on Thursday morning. Diaz refused to answer questions from reporters before being loaded into a waiting patrol car on the way to Queens Criminal Court for his arraignment.

Diaz has been charged with attempted murder, assault and endangering the welfare of a child, amNY reports.

According to a complaint filed in Queens Criminal Court, Diaz’s most recent arrest was for assaulting a UPS driver in broad daylight in Astoria on September 1, 2023.

He is accused of throwing a metal container at the driver’s side window of the truck, shattering it, then getting out of the vehicle and striking the driver in the head with the container, according to court documents.

According to the Queens District Attorney’s Office, Diaz pleaded guilty to disorderly conduct and was granted conditional release.

As part of the plea agreement, he was required to take a six-day anger management course, prosecutors said.
