California Democrats seem to have devised a method to impede President Donald Trump’s economic recovery strategy.

Proposition 12, known as the Farm Animal Confinement Initiative, is a voting measure targeting the ban of most egg and pork sales within the state. While California has laws that restrict specific confinement practices, this proposition was endorsed by voters in 2018 under the premise of animal welfare, building on California Proposition 2, which emphasizes animal movement without exact space specifications.

This new proposal extends those restrictions by setting minimum space standards for various farm animals, including veal calves, breeding pigs, and chickens raised for egg production. Additionally, it bars sales of meat and eggs from animals not raised in line with these regulations, regardless of where the animals were initially raised.

The stated goal of this law is to enhance animal welfare by decreasing extreme confinement on farms. However, the practical outcome has been a surge in egg and meat prices across the nation, including California. Policies instituted by the state have compelled farmers throughout the country to renovate their facilities to comply with the new demands, which has quietly inflated prices for essential grocery items for all Americans.

With the economy being a significant concern for voters in the 2024 presidential election, this policy threatens to undermine Trump’s efforts to make grocery prices more affordable. In July, the Trump administration filed a lawsuit, along with various officials from California’s government.

Newsom’s office has spoken out about the lawsuit, suggesting that Trump’s actions reflect his tendency to blame California for many issues.

In its decision, the US Supreme Court upheld Proposition 12 with a 5-4 vote in 2023.

“The Constitution addresses many significant issues, but the specifics of what pork chops California vendors can sell is not one of them,” wrote Judge Neil Gorsuch for the majority. “In a functioning democracy, such policy decisions typically fall to the populace and their elected officials.”

When Proposition 12 was approved in 2018, 63% of voters supported it. Yet, as grocery prices have escalated across the country, public sentiment has shifted. A recent poll indicated that 60% of Californians believe in amending Prop 12 to reduce egg and pork prices. Additionally, 44% would now reject Prop 12 if the vote were held today.

Critics argue that proponents of the proposition manipulate emotions by claiming it prevents animal cruelty and safeguards public health, without fully outlining the economic impacts of the new regulations. While they acknowledge that the proposal will increase consumer costs, they also assert that companies were already preparing for compliance before this law took effect.

However, specific figures detailing the increased costs for consumers outside of California are noticeably absent. Because out-of-state farmers must adhere to California’s regulations, the implications of this initiative could impact all Americans financially.

Additionally, Congressional Republicans are probing this matter, with the House Committee on Agriculture slated to conduct a hearing regarding Prop 12.

The court’s ruling suggested that producers had the option to engage with California’s market, but for many, being part of a market that represents nearly 15% of the national pork market isn’t really a choice. Experts have observed that pork prices in California have soared over 40% since the upholding of Proposition 12, and the overall cost to consumers is estimated to be around $300 million annually. This rise in cost affects producers as well.

Reducing grocery prices, especially for meat and eggs, is crucial for Trump’s economic recovery vision. If California’s proposition remains in place, the repercussions could be significant, potentially hindering Trump’s goals as all Americans face rising costs.
