California man will not be charged Shooting and killing Police say the person who broke into the apartment was her girlfriend’s ex-boyfriend.
The Sacramento County Sheriff’s Office said deputies responded to the scene of a reported shooting at the Sutter Crossing Apartment complex in Carmichael, Sacramento County, around 2 a.m. Sunday morning.

police Said Police found a man who had been shot, and later identified him as the ex-boyfriend of the woman who lived in the apartment. He had been banging on the door for 20 minutes until the woman opened it and forced her way in.
The sheriff’s office said the man then got into an argument with the woman’s current boyfriend and then shot and killed a man who had entered the home.
His current girlfriend told police that after her ex-boyfriend strangled her, she removed a gun from under her pillow and fired one shot at him. He was pronounced dead at the scene.
After receiving the police investigation report, the Sacramento County District Attorney’s Office determined the shooter should not be charged.
The sheriff’s office said his current girlfriend contacted police and is assisting with the investigation. Authorities added that the gun was registered with the shooter’s permit.
A local attorney named Michael Wise told KOVR-TV that California has a protective “self-defense” law.
“If this man was subjected to a deadly threat without provocation, he had the right to defend himself and kill the intruder,” Wise explained.
“The irony is that even if you are not licensed to possess a firearm, you can still be charged with illegal possession,” he added, “but even if you are not licensed to possess a firearm or have a weapon that is not registered in California, you may still be justified in using a deadly weapon in self-defense.”
KOVR reported that many neighbors were stunned that the shooter wasn’t charged and said they knew the victims well. The identities of those involved have not been released, but the names of the victims will be released after the coroner contacts next of kin.
Carmichael is a city of about 80,000 people located 10 miles northeast of Sacramento.
